Casa Culmet Arosa
1. Scope and Contracting Party
These Terms & Conditions apply to direct enquiries, reservations and stays at Casa Culmet Arosa, a holiday apartment in Arosa, Switzerland. The contractual partner for direct bookings is Zumstein Communications GmbH, 7050 Arosa, Switzerland, unless expressly stated otherwise in writing. Zumstein Communications GmbH operates the website, manages direct booking communication and administers the rental process on behalf of the property owner.
2. Booking Process
A booking is only confirmed once availability has been confirmed in writing, the guest has accepted the offer, the required payment or deposit has been received, and a written booking confirmation has been issued. Website enquiries are not binding until confirmed in writing.
3. Prices and Additional Charges
Prices vary depending on season, demand, length of stay and special event periods. Published rates are indicative until a booking is confirmed. Unless otherwise stated, final cleaning is CHF 175 per stay. Any applicable visitor, accommodation or tourism-related charges are charged or handled according to the applicable rules of the Municipality of Arosa and/or Arosa Tourism. Garage parking, WiFi, shared sauna access, bed linen and towels are included.
4. Payment Terms
Unless otherwise agreed in writing, a deposit of 30% is due upon booking confirmation. The remaining balance is due 30 days before arrival. For bookings made less than 30 days before arrival, the full amount is due upon booking confirmation. The booking is not guaranteed until the required payment has been received.
5. Cancellation Policy
Unless otherwise agreed in writing, cancellations more than 60 days before arrival are refunded in full, minus any bank or transaction fees. Cancellations 30 to 60 days before arrival are refunded at 50%. Cancellations less than 30 days before arrival, no-shows, late arrivals or early departures are not refunded. If the apartment can be re-rented for the same period, Zumstein Communications GmbH may refund the amount recovered from the replacement booking, minus reasonable administrative costs and any bank or transaction fees. Guests are strongly advised to take out travel insurance.
6. Occupancy and Minimum Stay
The apartment may accommodate a maximum of 4 adults, or 2 adults and up to 4 children. The standard minimum stay is 3 nights. During selected peak periods, including Christmas/New Year, February, the first half of March and mid-July to mid-August, bookings may be limited to Saturday-to-Saturday stays with a 7-night minimum. Special rules may apply during major Arosa event periods.
7. Check-in and Check-out
Unless otherwise agreed, check-in is from 15:00 and check-out is by 11:00. Early check-in or late check-out may be possible upon request but cannot be guaranteed. Guests receive check-in information before arrival.
8. Guest Responsibilities and House Rules
Guests must treat the apartment, furnishings, equipment and shared building facilities with care. No smoking, parties or events are permitted. Quiet hours and building rules must be respected. Waste must be disposed of according to local instructions. Ski equipment, bikes and wet outdoor gear must be stored only in designated areas.
9. Damage, Excess Cleaning and Security
No standard security deposit is required unless stated otherwise for a specific booking. Zumstein Communications GmbH reserves the right to request a security deposit of up to CHF 500 for selected bookings. Guests are liable for damage caused intentionally or negligently by themselves, accompanying guests, children or visitors. Zumstein Communications GmbH may charge guests for damage, lost keys or access devices, missing items, excessive cleaning, unauthorised guests or breach of house rules.
10. Pets
Pets are not permitted unless expressly agreed in writing before booking confirmation. If pets are approved, additional cleaning fees or conditions may apply.
11. Sauna, Shared Facilities and Parking
The shared sauna and other shared facilities are used at the guest's own responsibility and according to the building rules. Availability cannot be guaranteed if facilities are subject to maintenance or restrictions. Garage parking is included unless otherwise stated. Zumstein Communications GmbH and/or the property owner are not liable for loss, theft or damage to vehicles or personal belongings stored in the garage.
12. Liability and Force Majeure
Zumstein Communications GmbH and/or the property owner are not liable for loss or theft of personal belongings, accidents caused by improper use, temporary interruptions of utilities, internet, heating, sauna access or building services, weather conditions, road closures, transport disruptions, ski lift closures or events outside their reasonable control. Nothing in these Terms excludes liability where exclusion is not permitted by law.
13. Complaints
Any issues must be reported as soon as possible during the stay so that Zumstein Communications GmbH has the opportunity to resolve them. Complaints raised only after departure may not be considered if no opportunity was given to address the issue during the stay.
14. Data Protection
Personal data is processed in accordance with the Casa Culmet Arosa Privacy Policy, which forms part of the website information.
15. Changes to Bookings
Changes to confirmed bookings are subject to availability and written approval. Changes may result in price adjustments, especially if the new dates fall in another season, peak period or event period.
16. Governing Law and Jurisdiction
These Terms & Conditions are governed by Swiss law. The place of jurisdiction is Switzerland, unless mandatory legal provisions provide otherwise.
17. Severability
If any provision of these Terms & Conditions is invalid or unenforceable, the remaining provisions remain valid. The invalid provision shall be replaced by a valid provision that comes as close as possible to the intended purpose.
